WAIVER OF LIABILITY • ASSUMPTION OF RISK AND RELEASE • PUBLICITY RELEASE

Age Requirements: 9-17 to Throw with Parent or Guardian Signature | 18+ to Sign Waiver

IN CONSIDERATION of being permitted to participate in the World Axe Games Energized Experience™ and related events and activities (“Activities”) provided by World Axe Games, LLC (“WAG”), I HEREBY AGREE for myself, my heirs and my legal representatives:

I HEREBY REPRESENT, WARANT AND CERTIFY that I understand and assume all risks, known and unknown, of participating in the Activities, including the risk of illness, death or serious bodily injury. I further represent, warrant and certify that (1) I am in good health and am physically, emotionally and mentally able and ready to participate in the Activities; (2) I do not have any physical illness, injury or disability that would make my participation in said Activities a risk or dangerous to myself or others; and (3) if I elect to use my own equipment, that it is mechanically fit for my use in the Activities and not a danger to myself or others.

I accept and assume all such inherent dangers and risks of illness including without limitation the corona virus commonly known as COVID-19, bodily injury, permanent disability, death, and/or property damage, even if caused, in whole or in part, by the negligence of WAG, their respective members, managers, officers, directors, shareholders, affiliated organizations and entities, representatives, sponsors, volunteers, contractors, agents, and employees (collectively, “WAG Parties”).

I hereby agree to waive, release, hold harmless and/or discharge the WAG Parties from any and all claims, demands, damages, losses, injuries, liabilities, obligations, costs or expenses of any kind which are made or could be made by me, or on my behalf, or by my heirs or legal representatives as a result of my participation in the Activities including without limitations such claims that may arise due to the negligence, carelessness or recklessness of WAG Parties (“Release”).

I understand and agree that all alcohol on the premises must be provided by WAG and only alcoholic beverages purchased at WAG are permitted on the premises. If I elect to consume alcohol prior to or during my participation in the Activities, I agree to assume all risks, known and unknown, related to consuming such alcohol and agree to be responsible and liable for all claims, demands, damages, losses, injuries, liabilities, obligations, costs or expenses without limitation which may arise due to my consumption of said alcohol (“Claims”). I hereby agree to indemnify, defend, and hold harmless the WAG Parties from such Claims (“Indemnity”). The Release and Indemnity shall be collectively known as the “Waiver”.

I acknowledge and certify this Waiver is binding upon me, my heirs, executors, administrators, legal representatives, assigns and successors in interest. I understand that I am forfeiting my right to sue the WAG Parties and forfeiting other valuable and substantial rights in exchange for being permitted to participate in the Activities.

I understand and agree that always following all instructions and rules while participating in the Activities is a requirement for participation whether said instructions are communicated to me in writing or verbally by WAG employees. I agree that if I fail to follow said instructions and rules and act responsibly, I waive any right to continue participating in the Activities and any benefits associated with being a participant.

I hereby grant to WAG the right and uncompensated, unlimited use license to photograph, videotape or otherwise capture my image, appearance or likeness and to use such images for any legitimate and lawful purposes, commercial or otherwise.

By signing this Waiver including without limitation digitally accepting its terms, I certify that I have read the terms contained herein and agree to be bound by said terms and do so voluntarily and knowingly. I further certify that if I am signing this Waiver on behalf of my minor, I hereby execute this Waiver on behalf of my minor child with the understanding and acknowledgement that I am executing a release and waiver of potential claims on behalf of my minor child and myself.

I furthermore understand and accept that WAG may (1) not allow me to use any of my own equipment; and (2) eject me and all those in my party from the premises without liability or refunds if WAG believes in its sole discretion that I am not complying with safety protocols, management requests or that I am a danger to myself or others.

This Waiver is valid for twelve (12) months after signing (1-Year Waiver Anniversary); however, WAG may at its sole discretion require me to sign another waiver any time before and as many times as it requests before the 1-Year Anniversary.
